12.3.1.1 — Application

(1) This Section applies to the energy efficiency of a building or part of a building of residential occupancy that is within the scope of Part 9 and is intended for occupancy on a continuing basis during the winter months.

Defined terms on this page

occupancy

means the use or intended use of a building or part of a building for the shelter or support of persons, animals or property.

residential occupancy

means an occupancy in which sleeping accommodation is provided to residents who are not harboured for the purpose of receiving special care or treatment and are not involuntarily detained and includes an occupancy in which sleeping accommodation is provided to residents of a retirement home.

building

(a) a structure occupying an area greater than ten square metres consisting of a wall, roof and floor or any of them or a structural system serving the function thereof including all plumbing, works, fixtures and service systems appurtenant thereto,
(b) a structure occupying an area of ten square metres or less that contains plumbing, including the plumbing appurtenant thereto,
(c) plumbing not located in a structure,
(c.1) a sewage system, or
(d) structures designated in the building code; Act
